Services and Charges

Medition:  Mediation meetings are conducted virtually using conferencing platforms Currently Zoom provides the most compatible program, providing breakout rooms and joint meeting rooms. A Zoom invitation is provided to the attorneys who can then forward it to any persons whose attendance is appropriate. In this manner mediations can be conducted among widely scattered participants without their experiencing the inconvenience of travel. For mediations charges are incurred for time spent in the mediation meeting only. There is no charge for review of material submitted in advance of the mediation.

Arbitration:  Virtual arbitration hearings are also available.  In Arbitration matters the hourly rate plus expenses are charged for all time spent conducting the hearing, reviewing documents and briefs and preparing the award.   Because of the likelihood that the rendition of an arbitration award will result in the loss of at least one of the litigants as a future customer, arbitrations are charged at an enhanced rate, usually one and one half times the mediation rate.

Post meeting/hearing matters:  If a mediation fails, follow-up contacts will be made without charge unless it is clear that the impasse is hopeless, in which case there will be no follow-up contacts.  Post arbitration activities are charged at the full rate.
